Gambling Laws in the United States by State

The United States has some of the most fragmented gambling regulations of any major country. Casino legality is determined state by state, with results ranging from full commercial casino gambling to complete prohibition. For traveling gamblers, knowing which states allow what avoids surprises.

States with full commercial casino gambling

Nevada (since 1931), New Jersey (since 1976), Mississippi (1990s), Iowa, Illinois, Indiana, Louisiana, Michigan, Missouri, Pennsylvania, Colorado, South Dakota, West Virginia, Maryland, Massachusetts, Ohio, New York, Maine, and others have legal commercial casinos. The number has grown steadily through the 2010s and 2020s.

States with tribal-only casinos

Many states allow casinos only on Native American reservations under the Indian Gaming Regulatory Act. California has the largest tribal casino industry by revenue. Connecticut, New York, Wisconsin, Minnesota, Florida, Oklahoma, and many others have substantial tribal gaming. The casinos can be just as large as commercial casinos but operate under tribal sovereignty rather than state licensing.

States with limited gambling

Some states allow only specific types: pari-mutuel betting (horse racing), charitable gambling (bingo, raffles), or state lotteries without casinos. Examples include Texas (limited but a state lottery), Utah (complete prohibition), Hawaii (complete prohibition).

Online gambling

Online casino gambling is legal in a limited but growing list of states: New Jersey, Michigan, Pennsylvania, West Virginia, Connecticut, and a few others as of 2026. Sports betting is legal in significantly more states (around 40 as of 2026) following the 2018 Supreme Court ruling that struck down PASPA.

For traveling gamblers

Bring photo ID. All US casinos require valid government-issued ID for entry, age verification, and large transactions. Many states have minimum gambling ages of 21; some are 18. Always check the specific casino”s rules.

Cash and reporting

Casino transactions over USD 10,000 trigger federal Currency Transaction Reports (CTRs). This is not illegal but is documented for the IRS. Single-day transactions across multiple sessions can be aggregated.

Regional clusters

Major US casino destinations cluster regionally: Las Vegas and Reno (Nevada), Atlantic City (New Jersey), Mississippi Gulf Coast (Biloxi), Connecticut tribal casinos (Foxwoods/Mohegan Sun), regional commercial casinos (Detroit, Cincinnati, Pittsburgh, Philadelphia area). Driving distances often determine where local players go.
